II. Definitions
- Site - the website available at https://kwerenda.ai.
- Provider - the entity named in section I.
- User - any person using the Site.
- Consumer - a User who is a natural person using the Site for purposes not directly related to their business or profession.
- kwerenda.ai Service - the paid service giving access to the financial statement database, described on the Site and provided under a separate agreement concluded outside the Site.
III. What the Site is and what it offers
The Site is purely informational. The Provider supplies one electronic service through it: making content describing the kwerenda.ai Service available free of charge.
The Site has no user accounts, sign-up, log-in, newsletter, shopping cart or payments. Using the Site does not require providing any data; the only place where the User may provide it voluntarily is the contact form described below.
Contact with the Provider takes place by e-mail at kontakt@kwerenda.ai or through the contact form on the Site. The form is handled by an external provider (Web3Forms), which passes the submission on to the Provider's mailbox; the form creates no account and stores nothing in the browser. Using the form is voluntary; it requires a name, an e-mail address, a company name and the content of the message. How this data is processed is described in the Privacy policy.
Information about the kwerenda.ai Service, including pricing and the description of data coverage, is informational and constitutes an invitation to conclude a contract within the meaning of art. 71 of the Polish Civil Code, not an offer within the meaning of art. 66 § 1 of that Code. The terms of the kwerenda.ai Service, including fees, the data licence and the data processing agreement, are set out in a separate contract concluded with the client outside the Site.
The agreement for the electronic service is concluded when the User starts using the Site and ends when they leave it. The User may stop using the Site at any moment, at no cost.
IV. Technical requirements
Using the Site requires:
- a device with internet access,
- a web browser supporting HTML5,
- JavaScript enabled - without it the content remains readable, but interactive elements (tabs, the FAQ accordion, the mobile menu) will not work.
The Site stores no cookies and no other data in the User's browser. For that reason there is no cookie consent banner.
Using the internet carries the usual risks, in particular malicious software and interception of transmissions by unauthorised parties. The Provider uses an encrypted connection (HTTPS); keeping software and antivirus protection up to date is recommended.
V. Rules of use
The User undertakes to use the Site in accordance with the law and good practice. The following are prohibited in particular:
- actions that place excessive load on the Site's infrastructure, including automated content retrieval that disrupts its operation,
- attempts to gain unauthorised access to the Site or the infrastructure hosting it,
- introducing code or software that may disrupt the Site or compromise data security,
- supplying unlawful content.
If the User discovers a security vulnerability or a security incident, please report it to kontakt@kwerenda.ai. The Provider takes no legal action against people who report vulnerabilities in good faith and do not exploit them to cause harm.
VI. Content shown on the Site
Sample queries, AI assistant answers, code snippets, tables and company names shown on the Site are illustrative and serve only to demonstrate how the kwerenda.ai Service works. They are not results of real analyses and are not information about specific entities.
Statements about data coverage, the number of reported items, database size and update frequency describe the current state of the kwerenda.ai Service and may change. The binding scope of the service is set out in the contract referred to in section III.
Content on the Site does not constitute legal, tax or investment advice, nor an investment recommendation.
VII. Intellectual property
Rights to the layout, design, texts, graphics, software and other content of the Site belong to the Provider and are protected under the Polish Act of 4 February 1994 on copyright and related rights.
Use of the Site's content beyond permitted personal use requires the Provider's consent.
Third-party names and trademarks used on the Site (in particular Claude and ChatGPT) serve only to identify the tools the kwerenda.ai Service works with and belong to their owners. The Provider is neither affiliated with nor endorsed by those entities.
VIII. Liability
The Provider takes care to keep the Site working correctly and without interruption. The Site is provided free of charge and is informational in nature; the Provider does not guarantee uninterrupted availability and may temporarily limit access for maintenance or improvements.
The Provider is not liable for interruptions caused by force majeure, failures on the hosting provider's side or actions of third parties beyond its control, nor for the consequences of decisions made solely on the basis of information published on the Site.
The Provider is liable towards a Consumer on general terms set out by law. The provisions above neither limit nor exclude the Provider's liability to the extent that the law does not allow it, in particular liability for damage caused intentionally and for personal injury.
IX. Complaints
A complaint about how the Site works can be sent to kontakt@kwerenda.ai. It should describe the problem and give an e-mail address for contact. The Provider handles complaints within 14 days of receipt and informs the User of the outcome at that address.
A Consumer may use out-of-court dispute resolution, in particular by contacting the district or municipal consumer ombudsman or the regional inspector of the Trade Inspection. Information about those procedures is available from the Polish Office of Competition and Consumer Protection (uokik.gov.pl). Using them is voluntary.
Complaints regarding the kwerenda.ai Service are handled under the contract referred to in section III.
X. Personal data
How personal data is processed in connection with the Site is described in the Privacy policy, which forms an integral part of these terms.
The Site collects only aggregate visit statistics through Plausible Analytics, which stores no cookies and keeps no IP addresses.
XI. Changes to the terms
The Provider may change these terms for important reasons, namely:
- a change in the law affecting the service,
- a change in the scope or the way the Site works, including adding, modifying or removing its features,
- the need to comply with a court or administrative decision,
- security reasons or preventing abuse.
Amended terms apply from the moment they are published on the Site and cover use of the Site started after that moment. The date of the last change is given at the top of the document. Changes do not affect rights acquired by Users before they take effect.
A change to these terms does not affect contracts for the kwerenda.ai Service concluded before it takes effect.
XII. Final provisions
The Provider may discontinue the Site; this does not affect contracts for the kwerenda.ai Service, whose terms are set by a separate agreement.
Matters not covered by these terms are governed by Polish law, in particular the Civil Code and the Act of 18 July 2002 on providing services by electronic means. The choice of Polish law does not deprive a Consumer of the protection of mandatory provisions of the law of their country of habitual residence.
This English version is a translation provided for convenience. In case of any discrepancy, the Polish version of the terms prevails.
